Imprudent Driving in Manitoba

“Drive imprudently” is a distinct Manitoba Highway Traffic Act offence. It is not another name for careless driving, although the same incident can raise similar factual questions.

What does drive imprudently mean?

Section 95(2) prohibits driving at a speed or in a manner that is imprudent in light of all the circumstances. Those circumstances include the nature, condition and use of the highway and the amount of traffic that is, or might reasonably be expected to be, on it.

Current Manitoba consequences

The April 2026 Manitoba Brown Book assigns section 95(2) to fine category D, currently a $203 fine payable. MPI’s current Driver Safety Rating input-factor list assigns a two-level downward movement for a conviction. The exact consequences can depend on the charge, driving record and any additional offences.

Imprudent driving compared with careless driving

Imprudent driving focuses on whether the speed or manner of driving was unsuitable for the circumstances. Careless driving under section 188 focuses on driving without due care and attention or without reasonable consideration for other people using the highway.
