Appeal Process
Pay the fine
You must pay the fine set by the court upon conviction.
Device a plan
You have to prepare the Appeal. Gather all the paperwork which includes transcripts, court appearance notices, fine payment receipts, witness statements, etc.
File the appeal within 30 days
The Appeal must be prepared within 30 days. A Motion to extend may be filed if it’s more than 30 days however the Court is not obligated to accept it.
Attend Appeals Court
If your Appeal is accepted, you will be given a date to appear.

How long does an Appeal take in Ontario?
Once the appeal is perfected, it is placed on a list of appeals that are ready for hearing, usually within 6 months from the date of perfection. The appeal will then be assigned a hearing date that is dependent upon the nature of the appeal involved.

Appeal and Reopenings
If you are convicted in respect of a ticket without a hearing, you can apply to have your conviction struck out and a new trial scheduled. A justice of the peace can strike out your conviction if he or she is satisfied by your sworn affidavit that you were unable to attend the hearing or a meeting with the prosecutor, where applicable, through no fault of your own or that a notice or document relating to the offence was not delivered. You must make your application within fifteen days of becoming aware of the conviction.
