FIGHT YOUR TRAFFIC TICKET?

Why you need to fight Speeding Tickets

For many traffic tickets, it’s tempting to just pay the fine instead of going through the hassle of fighting the ticket.

Speeding Convictions Cost More than You Think – For speeding offences, the potential cost to you is much higher than the fine on the ticket. From the damage to your driving record due to demerit points, to the financial burden of higher vehicle insurance rates for at least three years, the real costs start if you plead guilty and pay the ticket.

Penalties for Speeding Tickets

In the Highway Traffic Act, speeding tickets can be found in Section 128. Speeding charges can result in demerit points being added to your driving record. The number of demerit points added to your record is based on how many kilometers over the speed limit you are found guilty of travelling.
  • 0-15km over: 0 demerit points
  • 16-29km over: 3 demerit points
  • 30-49km over: 4 demerit points
  • 50+ km over: 6 demerit points

Who sets the fines for Speeding

Although the Highway Traffic Act states different amounts, police officers are required to issue traffic tickets with the proper fines, set by the Chief Justice of Ontario.

Where the wrong fine has been used, the court may consider the mistake a fatal error and cancel, dismiss or quashed the ticket. For traffic tickets in Construction Zones or Community Safety Zones the officer may double the fine.
